1. Information about us and how to contact us

1.1   Who we are: We are Rhythm Time Ltd, a company registered in England and Wales. Our company registration number is 08871875 and our registered office is at 12 Victoria Road, Barnsley South Yorkshire S70 2BB. Our registered VAT number is 335795075.

1.2 All references to Rhythm Time shall, where appropriate, include Rhythm Time Limited, companies trading as Rhythm Time that have been authorised by Rhythm Time Limited and/or the appointed Rhythm Time regional franchise office that provides you with the course(s) from time to time.

1.3   These are the terms and conditions on which our Franchisees are licensed to provide Rhythm Time classes and supply their services to you. The specific Franchisee will be notified to you when you book your class. All customers are expected to abide by the terms and conditions set out below.

1.4 Please note that we are not the provider of the classes, and your contract is between you and the Franchisee.

1.5 Please read these terms and conditions carefully. These terms and conditions tell you who we are, how the Franchisees will provide services to you, how you and the Franchisees may change or end the contract, what to do if there is a problem as well as other important information.

1.5 How to contact us. You can find the contact details of your local Rhythm Time office by going to our class FINDER and entering your postcode and selecting a location.

1.6 How we may contact you. If we have to contact you, we will do so by telephone or by writing to you at the email address or postal address you provided to us when you booked. We may also use text as a means of communication.

1.7 Writing includes emails. When we use the words “writing” or “written” in these terms, this includes emails.

2. What we do

2.1 Music Classes – Rhythm Time provides music classes mainly to children under 5 of all abilities, including a wide range of special educational needs. Due to the way music affects the brain we can also offer classes to people of all ages with dementia or special educational needs.

2.2 Products – Rhythm Time sells and provides a range of branded merchandise and musical instruments to allow the child to enjoy music and play at home.

2.3 Resources – Rhythm Time provides a range of educational resources to support the learning of our pre-school children. This includes educational content to help reinforce what is covered in our lessons.

3. Lesson Fees – General Terms

3.1 Rhythm Time currently offers customers two ways to pay:

3.1.1 Pay in Advance: booked in blocks of lessons in advance; and

3.1.2 Pay Monthly: rolling 30-day contract with the ability to cancel any time online with 30 days’ notice – this does not include any Force Majeure circumstances i.e. National Lockdown.

3.2 Different terms apply depending on which choice you make which are set out below.

3.3   Please note Pay Monthly may only be offered for certain course types and is only available at participating Rhythm Time Offices.

3.4 You will be informed of the options available to you at the time of booking.

3.5 Once your booking is in place you will receive a confirmation email detailing what you have booked on what day and time and at which venue. You will also get access to your personal online account page where you can view your payment details at which point a contract will come into existence between you and the relevant Rhythm Time office.

3.6 It is your responsibility to change the generic online account password issued by Rhythm Time for first access or when re-setting a forgotten password via your local office. This should be a confidential password, unique to you, which you should keep safe and secure.

3.7 Fees can only be paid online via the Rhythm Time booking system which can be accessed in your account. Please note payment should not be made to Class Leaders under any circumstances and your lessons may not be deemed paid if payment is made to a Class Leader directly.

3.8 All fees and charges are itemised and available to view on your online account which can be accessed here.

4. Pay In Advance Lesson Fees and Payment

4.1 Lesson fees:

4.1.1 All course fees must be paid in full in advance of the start date of a course.

4.1.2 Payment can on be made via Credit Card only, online in your account

4.1.3 Children may not be allowed to participate in classes until the fees are paid in full.

4.2 Payment of Fees: Any lessons paid for, but not taken within a period of 3 months will be deemed to have been taken at which time there will be no refund offered.

5. Pay Monthly Lesson Fees and Payment

5.1 Lesson Fees:

5.1.1 Rhythm Time offers a Pay Monthly option for customers that offers great value and convenience. Pay monthly customers benefit from:

  • worry-free automatic re-enrolment each term – your child’s place within the class is secure;
  • lower lesson cost with the added benefit spreading the cost across the year
  • easy to cancel online, anytime.

5.1.2 This Pay Monthly option is offered with no minimum contract term. The notice period for cancellation is 30 days and you can cancel online, any time. This does not include any Force Majeure circumstances i.e. National Lockdown.

5.1.3 The Pay Monthly price calculation is based on a 36-week teaching year excluding school holidays where teaching does not usually take place. In the event of a franchise area teaching for a different number of weeks, this will be reflected in the monthly amount you pay. Pay Monthly allows you to spread the cost of classes across the whole year.

5.1.4 We will notify you of any changes to the monthly amount at least 30 days before it is due to change.

5.1.5 You may not be allowed to participate in any classes if monthly payments have been missed

5.2 Payment of fees:

5.2.1 When booking your lesson our system will advise you of the monthly fee which is payable in advance.

5.2.2 Our policy is to hold one month as a deposit which will be returned to you, less any amounts due, upon cancellation. Please be aware we will not give credit for lessons within the 30-day notice period if you choose or are unable to attend.

5.2.3 The deposit is payable each time a contract is taken out with Rhythm Time, even if a customer leaves or joins in quick succession. Your attention is drawn to the fact there is no cash saving in cancelling and re-joining within 30 days.

5.2.4 Payment can on be made via Debit/Credit Card only, online in your account.

5.2.5 We do not accept payments via American Express

5.2.6 If your account is in credit, the initial payment will be made up of the remainder of the current month and a full month in deposit. Your credit will then be used to offset your subsequent monthly payments.

5.3 Pay Monthly Cancellation:

5.3.1 You can cancel your Monthly Plan anytime, online via your account – please note all Pay Monthly plans are subject to 30 days’ notice.

5.3.2 The system will allow you to choose the date of your last lesson and advise you of any charges you are due to pay or credits you are due to receive including the deposit.

5.3.3 Any credits on your final balance including any additional credits that accrue during the 30-day cancellation period, can be repaid to you after your last lesson with Rhythm Time.

5.3.4 To request repayment of any amounts due please contact your local Rhythm Time office where they will endeavour to process this within 15 working days.

5.3.5 For security reasons, credits can only be applied to the card used to make payment.

6. General Terms

6.1 Your rights to change your mind

6.1.1 In accordance with the Consumer Contract Regulations 2013 you have the right to change your mind where you have purchased goods or services online. Under these regulations, you have 14 days after the day we email you to confirm we have accepted your order during which you can change your mind and get a full refund of any monies paid to us. To do so please contact us by email or telephone and we will arrange for the cancellation and refund of your money.

6.1.2 We will refund you the price you paid us by the method you used for payment. We will make any refunds due to you as soon as possible and, in any event, within 14 days of you telling us you wish to exercise your right to change your mind.

6.1.3 You must note that once you have attended a class you will lose your right to change your mind, even where the 14-day period is still running.

6.2 Cancellations and refund policy

6.2.1 Method of cancellation

(a) notice to the Rhythm Time local office;

(b) please note that a message left on an answer phone or voicemail is not considered as satisfactory notice; and

(c) that the Rhythm Time offices are closed at weekends.

6.3 Adverse Weather Conditions. Unfortunately, in this country, we are often on the receiving end of some really bad weather. Heavy rain, gale force winds, snow, ice and so on. This can sometimes result in a venue being closed and/or the Class Leader being unable to get in. If this happens, we will let you know with as much notice as possible. A catch-up lesson will be offered or where the local owner is unable to offer this, a credit will be applied to your account. But if the venue is open, our classes will go ahead. Where a class does go ahead and you don’t attend we won’t credit any missed classes.

6.4 Valuables: Rhythm Time Ltd will not accept liability for the loss of or damage to any personal effects brought by a customer to any class and you are therefore requested to ensure that no valuable items are brought to the venue. Rhythm Time cannot accept any responsibility for the loss or damage of any personal possessions before, during or after our classes.

6.4 Class Leaders

6.4.1 Our local Rhythm Time owners will endeavour to provide consistency with Class Leaders on a week to week basis for your class.

6.4.2 The suitability and subsequent appointment of a Class Leader shall be at the absolute discretion of the local Rhythm Time owner at all times.

6.4.2 Should a Class Leader start to teach a class but fail to complete the full term of lessons, which have been paid for, this will not constitute grounds for full or part refund of fees as long as Rhythm Time finds a suitable replacement Class Leader to teach the remainder of the term. Should Rhythm Time not be able to find a suitable replacement Class Leader, a credit will be offered towards the cost of a future course once a suitable Class Leader has been found. It remains at the absolute discretion of Rhythm Time to offer the alternative of a refund in such circumstances.

6.4.3 If you have any concerns as to the conduct or suitability of a Rhythm Time Class Leader, please contact your local Rhythm Time office who will discuss the matter with you and attempt to address any concerns you may have.

7. Illness

7.1 Transmission of infections: Any child or their carer known to be or found to be suffering from any infectious ailment or condition will not be allowed to participate in the class and it is the responsibility of each parent or guardian of the child to ensure that they are fit and well enough to participate. Rhythm Time will not accept liability for any infection passed to a child or carer by another child or carer in the class.

7.2 If a child or carer has Diarrhoea, they are highly infectious. As a result, they must not attend a class until 48 hours after symptoms have stopped.

7.2 We cannot offer a refund for a class missed due to illness. You may offer your place to a friend and their child.

Your correspondence will be forwarded to the appropriate local Rhythm Time office who are responsible for all aspects of Customer Service within their franchise areas.

Rhythm Time Ltd is a Franchise Support Centre and does not exist for the resolution of customer disputes. If you are not satisfied with how your local office has handled your concerns, please do write to us at the above email and we will investigate the matter.

9.1 The content of all of the pages of this website is for your general information and use only. It is subject to change without notice. Neither Rhythm Time nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on this website for any particular purpose. You acknowledge that such information and material may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.

9.2 Your use of any information or material on this website is entirely at your own risk, for which we shall not be liable. It shall be your own responsibility to ensure that any products, services or information available through this website meet your specific requirements.

9.3 All trademarks reproduced in this website, which are not the property of, or licensed to the operator, are acknowledged on the website.

9.7 Unauthorised use of this website or any content therein may give rise to a claim for damages against you and/or may be a criminal offence.

9.8 Any dispute arising out of use of the website is subject to and governed by the laws of England and Wales.

10. Our Products

10.1 All images of the instruments, clothing, and other goods on our website are illustrative only. Every effort has been made to display the true colours of each item but they may vary slightly from those images. All goods measurements are approximate only and the packaging may vary from that on our website.

You should always read the labels, warnings and instructions provided on or with the goods before using them and not rely solely on the information on our website. This notice does not affect your legal rights.

10.2 Goods offered for sale are subject to availability. If we are unable to fulfil your order within 5 working days we will contact you to offer a refund or advise of a likely delivery date.

10.3 We do not ship goods to outside England, Wales, Scotland or Northern Ireland.

11. Photos and Videos

11.1 We are very happy for you to take pictures or very short videos of your child during the class providing it doesn't interfere with the activity or other customers. We ask that you avoid taking pictures of others without their permission. If you are asked to stop, please do respect the rights of others.

11.2 Much of the content of our classes is under copyright and while we are very happy for you to enjoy singing the songs etc at home, these must not be incorporated into another public activity without our permission.
